Emmanuel Jacques Speaks to Forbes on the Complexities of Property Ownership by Sanctioned Individuals

Emmanuel Jacques Almosnino was interviewed by Forbes for an article on an abandoned property in Gustavia that is believed to be owned by Russian oligarch Roman Abramovich, but was never reported. Because of the sanctions against Mr. Abramovich, his assets were frozen, including the properties that he owned. But there is no certainty if the abandoned property was frozen.

This concerned Mr. Almosnino. “If the building is destroyed by a hurricane, who will pay?” he told Forbes. “He (Abramovich) cannot wire money to contractors to repair something or to complete construction in progress. It’s a very weird situation, not only for him, but also for everybody working for him.”

Only Six Cases Reported, All Patients Have Recovered Beaches Are Now Reopened

On September 6, 2017, the island of Saint Barts was hit by Hurricane Irma. With sustained winds of 185 miles per hour and gusts of up to 218 miles per hour, it devastated both the island and its economy. But, by the beginning of 2019, all traces of the natural disaster were gone, and Saint Barts provided an even more charming appeal than before. By the time it was Thanksgiving, Saint Barts’ most devoted visitors returned to the island.

This year, Saint Barts, like the rest of the world, was affected by the coronavirus. But, with residents following social distancing guidelines and a small number of cases, Emmanuel Jacques, Managing Attorney, Emmanuel Jacques Almosnino Law Firm (EJA), says the island is back in business.

“Beaches have reopened, and some businesses are returning to normal,” Mr. Jacques said. “Under those circumstances, the island is expecting the arrival of tests within the next few weeks to prove the population is in good health. This should allow a full reopening of all stores, restaurants and hotels.”

Saint Barts reported six cases of the coronavirus, five of whom were between the ages of 45 to 64, according to data from the Saint Barts government. Since then, they have recovered fully. Mr. Jacques said a number of factors contributed to the quick eradication of the disease.

“The island’s small size, the discipline shown by its inhabitants during the five weeks of lockdown, as well as its warm and sunny climate, make Saint Barts the perfect destination to be safe,” he said. “The island will continue to attract sea and beach lovers, who will be able to have peace of mind and enjoy their vacations this summer.”

With a predicted second wave of the disease expected to hit the U.S. again this winter, Mr. Jacques said the island will continue to provide an oasis of tranquility for its visitors. “Saint Barts will definitely become the place to spend next winter and to forget how the world was upside down in 2020,” he said. “The island has built a strong reputation for getting through times of crisis by offering a continuous improvement of its beauty and its art de vivre.”

Advises Property Owners to File their Claims by September 19, 2017 to Preserve their Legal Rights

On September 6, Hurricane Irma hit the Caribbean, including the island of Saint Barts, with sustained winds of 185 miles per hour and gusts of up to 218 miles per hour, destroying 10% of the houses, damaging almost all the villas and resorts and some of the crucial infrastructures of the island.

Emmanuel Jacques, Managing Attorney, Emmanuel Jacques Almosnino Law Firm (EJA), has traveled from Saint Barts following the storm. On September 14, 2017, he held an informational forum at the Restaurant at Rose Hill regarding the St. Barts’ recovery and how to file insurance claims. The event was streamed live on Facebook. Mr. Jacques has been monitoring the latest developments at Saint Barts. He said that, despite the damage to many of the homes and the some of the island’s infrastructure, there were no fatalities and the roads and government buildings sustained virtually no damage. The Saint Barts government is already back at work and electricity has been restored to the island. He also said the damages will be covered by the insurance companies.

Strong U.S. Dollar Helps Boost Saint Barts Real Estate Market

Emmanuel Jacques, Managing Partner, Emmanuel Jacques Almosnino Law Firm (EJA) in Saint Barts, says he is seeing more U.S. investors coming back in force in the Saint Barts real estate market as the euro has weakened against the U.S. dollar over the past several years.

According to data from the European Central Bank (ECB), the euro’s annual peak has decreased over the past few years. In 2014, reached a high of $1.3953, but, in 2015, that peak declined to $1.2043 and again in 2016 to $1.1569, on May 3. Since then, the euro has continued to decline. On June 23, the people of Great Britain voted to break away from the European Union, known as the “Brexit.” The effects were immediate as the euro fell from $1.1389 the day of the vote to $1.1066 the following day. The ECB shows the euro at $1.107 as of July 8. This is a 20% decline from the high in 2014, making Saint Barts real estate that much more affordable to American buyers.

Julius Baer Group Ltd., a lending institution based in Switzerland, predicts that the euro will fall to $1.08 by the end of the third quarter of 2016. Meanwhile, other international banks such as the Canadian Imperial Bank of Commerce are forecasting improvements in the U.S. economy, which should help increase the dollar against the euro for the foreseeable future.

The firm saw a significant increase in real estate transactions by Americans over the past year, assisting buyers in identifying real estate opportunities on the island, representing them in negotiating with sellers, obtaining financing and in closing the transaction. Mr. Jacques attributes the increase in U.S. investment in Saint Barts to lower purchase prices compared to the other famous destinations in the Caribbean or Europe.

“The enthusiasm for Saint Barts has grown over the past year, notably because Saint Barts became a high-value destination for an affordable price,” Mr. Jacques says. “Many investors the firm has assisted in acquiring real estate have continued to utilize the firm’s services in handling rentals and other matters on the island.”
